Welcome to BongMart. These Terms and Conditions (“Terms”) govern your access to and use of bongmart.ca (the “Website”), including any purchases you make through it. In these Terms, “BongMart”, “we”, “us” and “our” refer to the operator of the Website, and “you” and “your” refer to anyone who accesses or uses the Website.

1. Acceptance of These Terms

By accessing, browsing or placing an order on the Website, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, please do not use the Website.

Your use of the Website is also subject to our Privacy Policy, Shipping Policy and Return & Refund Policy, which are available on the Website. We collect, use and protect personal information in accordance with our Privacy Policy and applicable Canadian privacy laws.

2. Website Use Rules

You must be at least the age of majority in your province or territory of residence to create an account or place an order on the Website. By doing so, you confirm that you meet this requirement and that the information you provide to us is accurate, current and complete.

If you create an account, you are responsible for keeping your login details confidential and for all activity under your account. Please let us know promptly if you believe your account has been used without your permission.

When using the Website, you agree that you will not:

  1. use the Website for any unlawful purpose, or in breach of any applicable federal, provincial, territorial or municipal law;
  2. provide false or misleading information, or impersonate any person or organization;
  3. place fraudulent orders or use a payment method that you are not authorized to use;
  4. use bots, scrapers or other automated means to access, copy or collect content or data from the Website without our prior written consent;
  5. upload or transmit viruses, malware or other harmful code, or attempt to gain unauthorized access to the Website, its servers or any connected systems;
  6. interfere with or disrupt the operation, security or performance of the Website;
  7. post or send content that is unlawful, defamatory, obscene, hateful, harassing or that infringes the rights of others;
  8. send spam or other unsolicited commercial electronic messages through the Website, or otherwise act in breach of Canada’s Anti-Spam Legislation (CASL); or
  9. use the Website or its content for any commercial purpose, or to build a competing product or service, without our prior written consent.

You are responsible for complying with all laws that apply to your use of the Website and of any products you purchase. We may suspend or terminate your access to the Website, close your account or cancel your orders if we reasonably believe you have breached these Terms or applicable law.

3. Products, Prices and Orders

We make reasonable efforts to display our products, descriptions, images and prices accurately. However, colours, sizes and other details may vary slightly from how they appear on your screen, and we do not guarantee that all information on the Website is complete, current or error-free.

All prices are in Canadian dollars (CAD). Unless stated otherwise, prices do not include applicable taxes (such as GST/HST, PST or QST) or shipping charges, which will be added at checkout where applicable. Prices, promotions and product availability may change without notice.

Placing an order is an offer to purchase. We may accept or decline any order, limit quantities, or cancel an order, including where a product is unavailable, where there is an error in the price or description, or where we suspect fraud. If we cancel an order after you have been charged, we will refund the amount you paid for the cancelled items. Shipping, returns and refunds are governed by our Shipping Policy and Return & Refund Policy.

4. Content Ownership and Intellectual Property

The Website and all of its content, including text, product descriptions, photographs, images, graphics, logos, icons, videos, page layouts, design and software (collectively, “Content”), are owned by or licensed to BongMart and are protected by Canadian and international intellectual property laws, including the Copyright Act and the Trademarks Act.

The BongMart name and logo, and all related names, designs and slogans, are trademarks of BongMart or its licensors and may not be used without our prior written permission. All other trademarks shown on the Website belong to their respective owners.

We grant you a limited, personal, non-exclusive, non-transferable and revocable licence to access and use the Website for your own personal, non-commercial purposes, including browsing and purchasing products. Except as expressly permitted by these Terms or by law, you may not copy, reproduce, republish, download, modify, distribute, transmit, display, sell, create derivative works from, or otherwise exploit any Content without our prior written consent. Any unauthorized use of the Content ends your licence immediately and may violate copyright, trademark and other laws.

Your submissions. If you send us or post reviews, comments, photos, feedback or other material (“Submissions”), you confirm that you own it or have the right to share it and that it does not infringe anyone’s rights or break any law. You keep ownership of your Submissions, but you grant BongMart a non-exclusive, royalty-free, perpetual, worldwide licence to use, reproduce, modify, publish and display them in connection with the Website and our business. To the extent permitted by law, you waive any moral rights in your Submissions. We may remove or decline any Submission at our discretion.

If you believe that anything on the Website infringes your copyright or other rights, please contact us with a description of the material and your rights in it, and we will review your concern promptly.

5. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Website and all Content are provided on an “as is” and “as available” basis, without representations, warranties or conditions of any kind, whether express, implied or statutory, including any implied warranties or conditions of merchantable quality, fitness for a particular purpose, title or non-infringement.

We do not warrant that the Website will be uninterrupted, secure or error-free, that defects will be corrected, or that the Website or the servers that make it available are free of viruses or other harmful components. Information on the Website is provided for general information only and does not constitute professional advice.

The Website may contain links to third-party websites or services that we do not own or control. These links are provided for convenience only. We are not responsible for the content, policies or practices of any third-party website, and you use them at your own risk.

6. Limitation of Liability

To the fullest extent permitted by applicable law, BongMart and its owners, directors, officers, employees, agents, suppliers and licensors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or business opportunity, arising out of or in connection with your use of, or inability to use, the Website, the Content or any product purchased through the Website, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by applicable law, our total liability to you for any claim arising out of or relating to these Terms, the Website or any product purchased through it will not exceed the amount you paid to us for the product or order that gave rise to the claim.

7. Indemnity

To the extent permitted by applicable law, you agree to indemnify and hold harmless BongMart and its owners, directors, officers, employees and agents from any claims, losses, damages, liabilities, costs and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Website, or your violation of any law or the rights of any third party.

8. Your Rights Under Consumer Protection Laws

Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the consumer protection laws of your province or territory of residence, including any statutory warranties or conditions that cannot be excluded or limited by agreement. If you are a consumer, the disclaimers and limitations in Sections 5, 6 and 7 apply only to the extent permitted by those laws. If you live in Quebec, any provision of these Terms that is inconsistent with the Consumer Protection Act (Quebec) does not apply to you.

9. Governing Law and Jurisdiction

These Terms, and any dispute arising out of or relating to them, the Website or any purchase made through it, are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict of laws rules. You agree to submit to the non-exclusive jurisdiction of the courts of the Province of Ontario.

If you are a consumer, nothing in this section deprives you of the protection of the mandatory laws of your province or territory of residence, or of any right you have under those laws to bring a claim in the courts where you live.

10. Changes to These Terms

We may update or modify these Terms from time to time, for example to reflect changes in the law, our products or the way we operate. When we do, we will post the updated Terms on this page and change the “Last updated” date above. Changes take effect when posted unless we state otherwise, and they will not apply to orders placed before the change. Where applicable consumer protection laws require it, we will give you advance notice of material changes. Your continued use of the Website after changes are posted means you accept the updated Terms. If you do not agree with them, please stop using the Website.

11. General

If any provision of these Terms is found to be invalid or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision. These Terms, together with the policies referred to in Section 1, form the entire agreement between you and BongMart regarding your use of the Website. We may assign our rights and obligations under these Terms; you may not assign yours without our prior written consent.
